That was not the crime alleged. The alleged crime was the outing of Pflame. But nobody was charged with the crime, because Pflame had not been undercover for less than 5 years, so that by law there could have been no crime committed and no damage to the CIA. On record nobody was convicted of a crime and the law says no damage is committed 5 years after undercover.
