Dear Peter: I think you are reading too much into this. IMHO SUNW had no choice but to file this suit if they wished to protect their contract status. As to timing, you cannot file a suit until the misdeed is done. Thus as soon as MSFT began issuing their 4.0 upgrade with what SUNW alleges violates the "write it once etc" Java requirement for compatablility they filed the suit. I think its as simple as that.
