Hi, Pierre - As an estimate, which in this case is not all that much better than a guess, I think the settlement is in the $5M range. It would help to read the complaint to see what damages were asked, but I haven't full-text access to Eastern District of TX filings. In light of AutoTrader's ~ $100M revenues, I'm guessing ~ $1M - $2M actual damages, maybe a license that has a NPV of ~ $3M over its life. Plus costs, if the settlement was very favorable to GraphOn.

I hope GraphOn will use settlement proceeds to fund further development and assertion of its IP rights. This looks to me like the company's best avenue for shareholder equity value increase. Your point about their NOL is a good one, settlement revenues will be 100% available to the company. The rest of the company's operations don't seem to have much of an upside, at least to this untutored observer.

Over the next few days, I'll look at the three patents GraphOn is asserting against Juniper to get a feel for how strong their case might be relative to the strength of their apparently successful case against AutoTrader. I'll see if I can get a copy of the complaint against Juniper as well.

It will be interesting to see what GraphOn does about PR for this settlement. Absent the constraints of being a publicly-traded company, it would be in their interest to spread the news widely. On the other hand, they're in a small box regarding how vigorous they can be in discussing the implications for the company's future. One can hope that independent press reports will appear to publicize the settlement beyond what GraphOn can do.

Next target? Gotta think that one over....lots of big ships on the horizon...
