"Fort Sumner was in The Confederate States of America not in the United States of America." It was an American fort, occupied by American troops. Instead of trying a diplomatic solution, they were ordered to surrender. And when they didn't, were attacked. This was a dumb decision on the Confederate side. It gave the Union the excuse they needed to fight.
