That is only if its above 5%.. Most of them make sure its a tad under that level. If someone actually announces it while a stock is going up its definetely time to short it in the majority of cases, especially if its vinik. And to sell it the same, but only if they sold 5% of the shares in the company but they have time to file by then its too late for you to do anything. Unlike insiders who have to file before doing something.
