That's the way the Constitution is written; however, presidents have usurped that power.

And a large part of that are the chicken shit congresses that are afraid of the repercussions so avoid the responsibility. Thus the cop out "authorizations" without the determination. And they should be very afraid of the repercussions... that was the intent. Raise the bar by putting the decision with the elected officials that are closer to the people.

Its as much the fault of congress as it is the executive.
