ORDER OVERRULING MOTION FOR IMMEDIATE RELIEF

On the 20th day of December 2007, came on to be heard the Motion for Immediate Relief Pursuant to Order on Motion for Relief (“Motion for Immediate Relief”) filed by Pro Plas LLC, a Missouri limited liability company; John P. Murphy III Revocable Trust No. 1; 10315 LLC, a Missouri limited liability company; and John P. Murphy (collectively the “Murphy Entities”) filed in the above-styled and numbered case, the Chapter 11 Trustee, Kenneth Henry having filed an objection to the Motion for Immediate Relief and the Court being sufficiently advised,

IT IS HEREBY ORDERED AND ADJUDGED that the Motion for Immediate Relief is, hereby, denied.

It is further ordered, however, that the Murphy Entities may proceed to notice and to advertise a January foreclosure sale.

Pursuant to Local Rule 9022-1(c), Elizabeth Lee Thompson shall cause a copy of this order to be served on each of the parties designated to receive this order pursuant to Local Rule 9022-1(a) and shall file with the court a certificate of service of the order upon such parties within ten (10) days hereof.
