Patent infringement claims against Northwest withdrawn

Bethesda biotech Northwest Biotherapeutics Inc. said this morning that a competitor has withdrawn most of its claims in a patent infringement lawsuit.

The Lonza Group AG of Switzerland had claimed that cancer vaccine products made by Northwest Biotherapeutics infringed on certain gene expression technology patents held by Lonza, Northwest said in a press release this morning.

Northwest argued that it did not use any gene modification or gene expression systems from Lonza in the products.

Lonza filed its lawsuit on July 27 in federal court in Delaware, alleging that all of Northwest cancer products infringed on its gene expression patents.

Northwest filed a counterclaim seeking recovery for violation of the Delaware Deceptive Trade Practices Act, unfair competition and other offenses.

Lonza agreed to dismiss the case, but then filed a second lawsuit in Maryland. It later amended the lawsuit to challenge the patents only on drugs for treating prostate cancer.

That challenge is now the only one pending, Northwest said. The company said it disputes the allegation and will continue to fight it.
