They didn't know I wasn't completely out when I had my nose fixed. They said it was impossible for me to not be. I retold the jokes they were telling each other and that made a believer out of them. I don't remember much about the pain, but I sure do remember the sounds. I didn't sue anyone over it, I did however make sure that I spoke directly with the doctor that was going to be handling the anesthesia and let them know what happened to me before.
