I think most of us want fair laws, easily understood, based on common sense and then fairly enforced. *** With technology and refinement and with a willingness to pay for a high speed lane, or a post midnight "autobahn" type existence, the populace might be convinced to live by fair laws.
Indeed, that is what most of us "say" we want. But what we do is give gobs of cash to lawyers and other scam artists so they can take over K Street and bribe "our" Congressmen, military officers, and administrators into stacking innumerable legal decks so we can get the "fair laws" of our choice... or, failing that, get us off with a pardon, probation or a minimal sentence. I mean... when we're playing by the so called "rules"... that's how we do it. <vbg>
It's pretty much been that way since Hammurabi with the selective enforcement too. The biggest difference today is the increased availability of information we now "enjoy."
But more information and visibility won't change Elgindy's nature any more than locking him up has. And it certainly won't keep him or his "legions" from using one of the infinite varieties of deception to "stomp" others. At best you can force him to wear sneakers... for a while. <vbg>
You can take the Tiger out of the wild... but the Tiger will always be wild. We can and do win some battles, but the war to end man's predatory ways will go on as long as we do.
Based on Elgindy's recent "memo," I'd have to say that any hope of changing his ways is pretty much DOA. As best I can tell he and many of the humans opposing the elimination of naked shorting (be they bankers, Fed Chairmen, SEC employees or congressmen:) simply do not see the world in the way we do. They are either agnostic, or totally devoid of empathy, towards the "long buyer's" view of life. They are certainly different. But so too were "machinists" and "monetarists" before the late 1800's.
Keeping Elgindy in jail won't prevent his brand of financial wrong doing... any more than throwing Adam out of the garden solved any problems. I'm just not in favor of paying his room and board for one day, much less a life time.
I say save the cash. Forget the retrial and just let him go. If he gets caught with his hand in my pocket... then I say cut off his gonads and feed them to a Tiger. <Hoo><Hoo><Haa>
