First, a point of detail -- no "conviction" is involved, since this is a civil, not a criminal suit.

Second, what I said was "I doubt ..." which clearly indicates, IMHO, that it is my opinion (perhaps I should have said "alleged failure to comply"). Of course it is up to the judge (or perhaps jury, for at least part of the case) to decide.

I don't deny I have an opinion regarding this situation -- call it bias if you wish. And I have made no secret of the fact that I hold a substantial (to me) position in SUNW, and have never owned any position in MSFT.

Good to hear from you again.
