As far as I know FRANDly rates are set by the market. The EU is attempting to determine whether Q's pricing is violating Frand terms. Brcm brought these allegations and Judge Selna has made a determination on the costs of 2 patents exceeding anything Q charges. The EU will definitely take into consideration this court decision. In addition this now allows Q to charge more for patents not yet covered by the Standards.
