As far as I know FRANDly rates are set by the market. What would the point of FRAND be if any rate set by the market was automatically acceptable? That would make it impossible to have a non-FRAND'ly rate...and I really doubt that is going to be the conclusion of the EU. Judge Selna has made a determination on the costs of 2 patents exceeding anything Q charges. The EU will definitely take into consideration this court decision. In addition this now allows Q to charge more for patents not yet covered by the Standards. The rates that Selna put into place are in line with other judgements. It isnt like this is the first patent case that has ever had a royalty rate set by a judge. Slacker
