Part of Intel's defense is that they claim that first $ rebates are legal and the EU says they aren't. In the case of British Air vs. Virgin Air, which involved rebates to travel agents, the EU has already held that setting trigger points as a percentage of previous year sales is illegal, even if the same percentage applied to everybody.

Perhaps the real reason Intel has dropped 18% in the last 5 days and has suffered two downgrades is because some of the brokerage firms know that the EU is not changing their interpretation of the law. Worldwide computer demand is not taking a dump, and 70-75% of Intel and AMD's sales are international.
