Maybe it should but social security didn't at least not in a practical sense (whether or not it is truly constitutional effectively it is because the courts have not struck it down).

Yes people aren't actually required to be enrolled in social security at birth (can't claim them as a deduction if you don't enroll, but you could skip the deduction), but you can't avoid the program forever (if you work you have to pay SS taxes)
