AMENDED ORDER APPROVING COMPROMISE AND SETTLEMENT AGREEMENT
On the 10th day of January, 2008 came on to be heard the Joint Motion for Approval of Compromise and Settle Agreement ("Joint Motion") filed in the above-styled and numbered case by John P. Murphy III Revocable Trust No. 1; Pro Plas, LLC, a Missouri limited liability company; 10315 LLC, a Missouri limited liability company; and John P. Murphy III (collectively the "Murphy Entities"); Chapter 7 Trustee Kenneth Henry ("Trustee Henry"), the duly appointed Trustee of the Bankruptcy Estate of Pro Mold, Inc.; and Chapter 7 Trustee Stephen Palmer ("Trustee Palmer"), the duly appointed Trustee of the Bankruptcy Estate of Plasticon International, Inc. The parties received notice of the filing of the Joint Motion and the Compromise and Settlement Agreement ("Agreement"), the filing of the Joint Motion to Shorten Time for Notice and Opportunity to Object and the hearing thereon. Prior to the hearing, the parties reached an agreement with All Points Capital Corporation ("All Points") to amend the Agreement as set forth in Exhibit B. Further, the Court finds as follows:
IT IS HEREBY ORDERED, ADJUDGED AND DECREED that the Compromise and Settlement Agreement entered into between the Murphy Entities, Trustee Henry and Trustee Palmer in the form attached as Exhibit A to the Joint Motion to Approve Compromise and Settlement Agreement as modified by All Points Capital Corporation Provisions, attached hereto as Exhibit B, shall be and is hereby approved.
Pursuant to Local Rule 9022-1(c), Elizabeth Lee Thompson shall cause a copy of this order to be served on each of the parties listed below pursuant to Local Rule 9022-1(a) and shall file with the court a certificate of service of the order upon such parties within ten (10) days hereof.
