From Anthony Elgindy...
For those so inclined, Ive picked out a few of the more significant points and issues that are raised in my case and my prosecution of the appeal of my conviction..Im doing this primarily because Im bored and interested in any views or comments that others may have to share. I figured Id start out with the biggest issue upfront ("9/11")and get to the others a little later...
For those who dont know, on May 22nd, 2002, the day after I was arrested in San Diego, an idiot prosecutor named Kenneth Breen flew across the country , from NY, so that he could grandstand in a courtroom full of reporters and utter the following words, words that he knew absolutely to be false...
"[P]erhaps Mr. Elgindy had pre-knowledge of September 11th, and rather than report it he attempted to profit from it."
These words have and will continue to be the the most irresponsible, wreckless, unfounded and idiotic remarks he's ever uttered in his entire life. These words destroyed not only my life, but the lives of my entire family.
This man then set out to defend his pathetic public display, by filing one "sealed" motion after another, inorder, to try and persuade the court to allow him to bring 9/11 into this stock trading case. At that time only Breen that the only way he could possibly beat me and "convict" me of any of his bogus and fabricated charges, based upon no existing law, was to lie, cheat and and subborn perjury. He knew that he needed to get 9/11 in the case somehow and at any cost.
Therefore, for all the conspiracy fruit-cakes out there that continue to insist that there is some connection between me or my family and 9/11 or "terrorism" in general, I will offer you the actual findings of the court and the Judge's own remarks on the matter........ It really doesnt get any simpler than this.......
The judge spoke to the jury after having already read and reviewed every single document, every single shred of alleged "evidence" and every single thing EVER filed under "seal"...and this is what he came up with for the jury.
THE COURT: Let me just interrupt here a second, folks, lest there be any misunderstanding. This case has nothing to do with terrorism. I want to make that point very strongly to you. There are no such charges in this case or any other and you will not hear any evidence that Mr. Elgindy or anyone else was involved in or aided the events of September 11th. Please understand this.
There was an investigation. Indeed, as I'm sure you can appreciate, there were many investigations. One such inquiry sought for a time to determine whether or not stock trading records might provide some indication that individuals had prior knowledge of the events of September 11th. All right. But this case does not involve such allegations. There are no charges. I couldn't repeat that more strongly to you. In sharing this information with you I need to emphasize to you that I make no comment about the credibility of this witness or any witness or the significance or weight to attach to this testimony should you credit it. Those are issues, as you know, left exclusively to the jury, as I've already instructed you. So, please don't be misled by this.
So there you have it, why again was 9/11 brought in to the case ??? Because Breen couldnt win any other possible way. He lied, he cheated and he broke the law. He makes that idiot prosecutor, "Myfong" look like a saint compared to himself.
