Sounds like a huge gift to trial lawyers that guarantees a tsunami of ridiculous litigation.
The way this thing reads, it sounds like it's saying that the burden of proof in "discrimination" claims will shift from the person making the claim to the state employer (or an employer receiving federal funds) having to prove that it didn't allow for conditions in which discrimination supposedly ocurred. In other words, an employer need not discriminate, but if one employee says something ugly to another employee, the employer may be held accountable for any perceived slur uttered by any of its employees whether the employer is actually responsible or not. The ACLU, which natch, supports this bill, seems to confirm my reading:
Ensure that federal funds are not used to subsidize discrimination and hold recipients of federal funds accountable for discrimination that occurs on their watch.
It also gives illegals the right to sue and pick up legal fees and back pay for "labor and employment law violations." (This one might backfire on them though, as it may cause some employers to stop employing illegals for fear of lawsuits, but it is still dangerous to start showering illegals with a bunch of laws gift-wrapped just for them.)
Another section is titled "ENHANCED ENFORCEMENT OF EQUAL PAY REQUIREMENTS"
Scary. All of it.
Obama has even pulled his press release (it was orginally posted Jan. 24), but it does not appear on his press release roll any more. Why would he be seeking cover unless this thing is going to be hugely unpopular? He is even listed as a co-sponsor. Nothing on his campaign website.
Nothing on Hillary's website either, even though she too is a co-sponsor. Nothing on her campaign site.
Obviously, they are afraid of what Americans might think about their association with this bill. It deserves some investigation…after all, there is a presidential campaign going on and they seem to running away from this bill.
With this Star Wars bar scene supporting it, it's easy to see why these two candidates would recognize that this bill would not be supported by anyone but the Leftist fringe. If the ACLU, La Raza, PFAW, AAUW and the NAACP are in favor, it can't be good for America.
