Lane, I believe that rate is not a negotiated rate at all, but one dictated by Medicare that reduces rates to 1970's negotiated rates as a means of balancing their budget. A useful way of thinking about it is by saying that when you went to the gas station you told the store owner that you were paying 38.9 cents per gallon for the gas you just pumped.
