It would seem so, wouldn't it? But only if david is right. In fact, it rather seems like a "no-win situation" for david. If david has some inside information that he knows to be correct and he's willing to exploit it for his own self-gratification, then yes, that would seem to be not only a violation of terms, but at the core a question of "character and integrity" that we hear so much about from the Brinkerbashers.

If he is just egotistically blowing smoke, then he's no better than anyone else at guessing identities, and very likely wrong again.
