3 establish that your client passed on certain information that
4 he had received from Mr. --
5 MR. GERZOG: What Mr. Royer testified to is that on
6 9/11 Mr. Elgindy called him and said hey guy, look at the
7 trading in Vornado and a couple of other stocks. He passed
8 it on to the SEC and the FBI.
9 Mr. Levine challenged that assertion and this is a
10 contemporaneous writing indicating that either it happened or
11 Mr. Royer was shrewd enough to make up an E-mail at the time
12 bolstering the story he knew he'd have to tell later.
13 MR. LEVINE: Actually, Judge, I didn't get into
14 this in my examination. Nonetheless, he can offer this
15 pursuant to the government's understanding of the Court's
16 directions earlier today.
17 MR. GERZOG: About the door, the famous door.
18 MR. BREEN: What we would object to is
19 Mr. Gerzog --
20 THE COURT: I don't know what directions I gave. I
21 simply said to Mr. Berke that if he puts that E-mail in he
22 does so at his peril.
23 MR. BERKE: I didn't put that E-mail in.
