If waterboarding is determined by law not to be torture, tnen people don't break torture laws when using it. That is a legal fact. I can't tell from what you posted about what your friend was whining over, whether or not that determination has been made.

However, you said McCain voted for torture and that is not substantiated in your post anywhere.
