Following your logic, the motive for a crime defines whether it is a crime or not? That is what you are saying, and picking something arbitrary like motive, the thing that can never be proven definitively, you will always be able to argue your case and feel like you are right. It's like saying god (or fill in random imaginary figment) exists, prove that he doesn't.
So maybe Rafael Palmeiro, who must have really messed up his nuts by cycling steroids improperly and then became a spokesman for Viagra (what a coincidence), maybe he only went back on roids afterward because he wanted to get his dick hard and the Viagra was messing with his heart.
We could make up an excuse for everyone.
