Hanging isn't lynching. And lynching doesn't necessarily mean the victim is hung, although that is about the only way it is used anymore.
Lynching, an enumerated felony in some states in the U.S.A., is defined by some codes of law as "Any act of violence inflicted by a mob upon the body of another person which results in the death of the person," with a 'mob' being defined as "the assemblage of two or more persons, without color or authority of law, for the premeditated purpose and with the premeditated intent of committing an act of violence upon the person of another." Lynching in the second degree is defined as "Any act of violence inflicted by a mob upon the body of another person and from which death does not result."[1] To sustain a conviction for lynching at least some evidence of premeditation must be produced, however "The common intent to do violence" may be formed before or during the assemblage."[2]

Now, only because you are such a moron, let me weigh in on the racial overtones of lynching. Despite your frantic spinning, it most certainly has racial implications. Lynching became synonymous to the South when the Republicans imposed Radical Reconstruction. Now, the lynchings started because, in typical Republican fashion, if you were criminally inclined and a Republican, and the two were almost the same during those days, you could do no wrong. The soldiers wouldn't bother you, much less arrest you. So the lynchings started a way of protecting ourselves from the carpetbaggers that y'all shipped down here in unending streams. Oh, we had our scalawags too. And because they were Republicans, the "law" didn't bother them either. Anyway, after those locust had stripped the South bare, most of the carpetbaggers slunk back to whatever damp rock they oozed out from under and the lynching for unofficial law enforcement subsided. Unfortunately, instead of dying out, it transformed into a way to keep blacks under control. The sons of Ham getting a little uppity? Well, catch one, accuse him of, say, approaching a white woman for some hot, jungle monkey sex and decorate a tree with him. And, it worked like a charm. As a result, it hung around for decades.
And, blacks know it. Which is why Clarence Thomas complained of "a high tech lynching". And it is why O'Reilly stirred up some major fecal material. |
