Is this why the loan can still be sold? In a word, yes. But to be fair it's not just stupidity or weakness. Some people feel really bad about discharging debts in bankruptcy. After all, they are breaking an oath. People file bankruptcy because they don't see any way out, but a significant percentage feel bad about it, and want to make good on their promises.
