Lincoln initially freed the southern slaves due to limitations of the constitution. Freeing southern slaves was justified on military grounds. Missouri, Kentucky and Maryland were slave states that remained in the union and Lincoln did not want to drive them out. Slavery was a legal institution and Lincoln was restricted in what he could and could not do. The Emancipation Proclamation made it clear though where he was going and helped the Union gain the high ground on the issue.
