Tim Fowler, re: "The California labor board has ruled, in its infinite wisdom, that my company is responsible* for the unemployment insurance payments to an employee who got hurt when he wrecked his motorcycle on his own time and was physically unable to work. So an employee gets hurt in his off time and leaves us in the lurch when he can't work during our busiest season, and we owe him money for staying home?"

WOW!

One of your employees pays into unemployment insurance to cover him in the event he's involuntarily unemployed for a reason other than a just firing and your big concern is to fight his benefits, lose and complain about how your business gets "left in the lurch."

And because you "lost" you pay only pennies on the dollar in additional UI payments while he now has injuries and a substantial reduction in income while his expenses continue at the same rate.

If you'd "won" then he'd be deep in trouble, wouldn't he?

I'd guess that your employees now understand your views clearly. Good luck if you ever find you need their loyalty. Ed
