Is there still any kind of bear count if 1406 is exceeded?

Yes. For example, the Jan low could be Wave A; a rally above 1406 may be "B" -- with a large "C" down pending.

Or, the fall from Dec 11 could be 1 of 3. The rally above 1406 could be 2 of 3.

Yet another (albeit unlikely) possibility could be that we already "had" a weak failed 5th.

All that said, a rally above 1406 would be a bullish development, and at that point the odds would turn against the bear.
