John, your question about medical malpractice lawsuits against the US federal government is a good one, and deserves a good answer.

The answer is that the Federal Tort Claims Act (FTCA) allows medical malpractice claims against government health care providers and facilities.

Active duty military cannot bring a FTCA claim due to what is called the Feres doctrine.

This is an over-simplification, there are many exceptions, pitfalls, and loopholes, which is why people hire trial lawyers. We know how to navigate the complications, which is why we get paid the big bucks.
