Mr. Owl - you must have been viewing Kudlow as he had the President. "Moral hazard" was the balance he was claiming to steer between, with stabilizing the economy on the other end of the scale. It was high brow economics, with an emphasis on the brow and snicker.

Of course, if we were being serious, I'd fashion something other than your 3 choices. Let's start with the likely pay packages of the Bear Stearns top 100 or 200. They justified the 100's of millions while creating this fiasco. Perhaps give them the choice of hanging or giving it all back other than subsistence wages of perhaps $100,000. I'm guessing now but I believe Dictator NightOwl could get close to a billion bucks here. Next go down the road and do a bit of disgorgement and perhaps raise another billion.

Now back to your 3 choices - if that's all I get, I'd probably go with #1, government takes over the mortgage business, hires some hungry law and MBA students and recent graduates at $65,000, and tells them to work out deals first, litigate and foreclose only as a last resort. Holders in due course have mandatory delays with respect to enforcement and have to deal in good faith, based on reasonable expectations given the facts as of the time of the origination of the paper.
