The biogenerics bill that eventually gets passed by Congress and signed into law will not impose a brand new exclusivity clock for biopharmaceuticals already being marketed. Rather, the exclusivity clock will start at the time of FDA approval. You can take that to the bank.

The length of the exclusivity period remains in doubt.
