DANB is being sued by the Edison Brothers creditors to recover the shortfall resulting from Edison Brothers emergence from bankruptcy. They evidently are going after shares distributed in the Spin-Off as well as other property. I don't see this suit being very successfull but in the near term it is probably a significant hurdle for the stock. This information was reported on the Motley Fool boards and was also disclosed in the Form 424B4 filed by DANB on Friday (should be up at the SEC tomorrow. I have bailed on the stock. For me this decision was based as much as a need for cash (for a house downpayment sometime in the near future) as concern for the stock. The company itself is doing great (and are expanding into Mexico via a new partner) and I expect to buy back in when this news has been absorbed (even if I have to pay a higher price).
