Letter Sent to CBOE on Behalf of NOVS's Shareholders

Dear Linda,

I am the president of the National Investor Protection Coalition and it has come to my attention that there have apparently been new derivative contracts opened for the underlying security of NOVS.PK in violation of CBOE rule 5.3. (Criteria for Underlying Securities).

Please investigate and use your SRO police powers to enforce your own rules against your own members as you are required to under Section 19 of the Securities Exchange Act of 1934. In addition to being in violation of CBOE rules, these actions may also be in violation of California California Corporations Code § § 25400 and California Business & Professions Code § § 17200 and 17500. Please see the Novastar share holder suit against prime brokers for more information.

I am deeply concerned that the CBOE may not be adequately policing its members and enforcing its own rules. Or conversely, that CBOE members may be flaunting the rules. If you could get back to me on the results of any investigations you undertake in this matter, it would be greatly appreciated.
