I think you started your series of posts with a quote in which proportionate was italicized. Was that not the key issue? That charges for IP must be proportionate?

You are right that a cap implies the charges are not proportionate mathematically speaking. I don't think that matters.

The point of my analogy was to show courts accept a non-linear punishment scale, and still consider it proportionate. If a nonlinear scale is good enough for criminal punishment, it's good enough for commercial reward.
