I don't think you have to have "evidence" or "probable cause" to detain a prisoner of war.

I didn't know we were at war with Germany or Pakistan. Did you see the story?

PS. You did not answer the rest of my note...specifically, how did he suddenly stop being a POW/or terrorist at Merkel's request?
