2 discrete issues that may or may not interact when there is a crisis. The issue of naked shorting, failure to deliver and the issue of what happens if a broker fails.

I was a customer of a brokerage that failed early in the SIPC era and I got all my shares even though there was a delay. I couldn't trade out in the interim and that's the only real risk. How long does it take today? With electronics, I would imagine that customers could be made whole in days rather than weeks or months as it was back then. It really is just a matter of flicking a switch on a computer.

Now that leads to "our" issue here, where we do not know if there are real shares being shorted.
