I would find it very hard to believe that evidence as critical as the evidence you keep posting would be held back from the judge. If it were true, and the evidence was not admissable in court, then there is some reason its tainted and not admissable.

The full content was not made public" does not mean that the judge did not see it.

I think it does. Do judges consider evidence the defense can't see? How fair would that be?

Furthermore, the judge's ruling was in 2005, wasn't it?

The infornation in the World Politics Review article came out in summary form only in 2007. The BKA file itself is still not public info.
