I think people should be able to use the drugs with no approval, but some seal of approval (whether from the FDA or from something like Underwriters Laboratories or some other private sector source is useful.

Only drugs that get some seal of approval are likely to get coverage from insurance. The unapproved drugs might not get mass manufactured, and I think I'm ok with that, but I don't think you should prosecute people for using them, or even for selling them (as long as there is no fraud involved)
