There are people suffering with side effects now. Yes such effects probably would increase if you don't punish people for using drugs, but I don't consider that enough justification to send people to jail for using drugs to try to take care of severe medical conditions. "This might make you ill" isn't enough justification for "since you used it we will send you to prison".
