What collateral damage? Punish crimes = people harming other people. Drunk driving doesn't harm other people. If people drive drunk and crash into somebody, use them as organ donors. Pretty soon, nobody will crash into other people when they are drunk. Heck, even if they aren't drunk and crash into people, use them as organ donors.

Nature does that with cliffs. Drive off a cliff, the punishment is to have your protein recycled. No ifs, buts or long drawn out court discussions.

Okay, maybe organ donor is excessive for the most part. Serious financial and other penalties would induce good behaviour.

But don't punish drunk driving. Punish making a mistake. It's easy to drive drunk if one is cautious. Go slowly, concentrate like crazy. I had one of my best halves at golf while sobering up after drinking a bottle of wine on an empty stomach. I had to make sure my feet were well planted so I could balance, then focus really hard on the ball so I could know where it was. No distractions. Of course it wasn't my best, I was really surprised and somewhat concerned about my normal lack of focus. But I won $50 from my buddy who knows I can't handle alcohol and thought it would be an easy $50.
