Yes, it was Lupin who said Q was not infringing. But I think he meant that as long as the agreement between NOK and QCOM is still active, QCOM is not infringing.

I don't see how there's any room for your interpretation from Lupin's comment:

"We have never believed that Nokia's patents are applicable to our products."

apparently NOK uses a lot more QCOM IP than does QCOM use Nokia IP.

I don't think you'll find anyone arguing against that.
