Okay fair enough. I think I'll vote for the Democratic nominee this year because I want jurists who believe in the land of liberty that I grew up in, not the land of Big Brother that George Bush has forced upon us, where even American citizens can be taken in the middle of the night and held without trial indefinitely if suspected of being a terrorist. How can that be justified by a Supreme Court Justice unless they govern from the bench and ignore the Constitution and have a partisan bias. That was not America when I grew up in the 1970s and 1980s or lived in during the 1990s. It's not just the ACLU that is upset about this draconian federal power grab that goes against the very grain of America and is clearly unconstitutional, it's also a lot of right leaning Libertarians who know the Republicans have morphed into a strange American breed on nationalists who are vesting too much power in the federal state.

I found it interesting the Alito and Scalia were the only two justices that sided with the State of New Jersey in a recent landmark case that the State of Delware brought regarding a territorial dispute. Seems kind of odd that the two justices from New Jersey found a way to come up with a decision that favored their home state. Seems as if some of these conservative justices are not above legistlating from the bench when they feel strongly about something.
