Jim, I can't help but mention: Not having a patent on a chemical process is disturbing but not unprecedented. There once was a guy by the name of Edwin Land who worried that he would have to disclose too much information about his process on the patent application. Instead, he kept his secrets to himself and challenged the world to figure his process out if they could. His process was for the rapid self-development of photographs and his company was Polaroid, which as I'm sure you know, was mildly successful.
