Tim - it is a hard call in the face of what is currently going on. XM and SIRI are merging to a monopoly, and the DOJ has refused to stop it. Should they have unfettered access to ALL the spectrum, or should they be required to give up some to other interested parties? I think the rumored outcome -- that they will be required to hand off 8 channels to minorities, is not a very sensible one. However, it gets the FCC off the hook on the competition issue, I suppose. I think the FCC's rules surrounding spectrum are way, way over my head. But it seems strange to me that they made the rule requiring XM/SIRI to keep their spectrum separate then to just ignore that rule if they choose to do so? Strange.
