Hypothetical Rules Question;

I ask this because it's occurred to me to do it more than once, but it's unethical.

------------

The Rule as it stands is that dividends are not included. Well, I don't know if it's a Rule or not, I just know that Leroy doesn't count dividends.

So, Company X trading at $90 declares a Special Dividend of $10. I Sell it Short.

The day of the Dividend, all else being equal, the stock opens at $80 due to the Special Dividend and I Close out the position. The stock closes at $81.

Technically, I have a dollar loss. In terms of the Contest I have a 10% gain.

What's the Rule?
