They specifically request comment as follows and these are issues which will continue to contribute to the problem of manipulative NSS: Request for Comment The Commission seeks comment generally on all aspects of proposed Rule 10b-21. In addition, we seek comment on the following: • Proposed Rule 10b-21 would apply to sales in all equity securities. Should we narrow the scope of the proposed rule to apply only to sales of “threshold securities” as that term is defined in Rule 203(c)(6) of Regulation SHO44 or to certain types of securities? Why or why not? If so, to what types of securities should the proposed rule apply? If we narrow the proposed rule to apply only to certain types of securities, should exchange traded funds or other basket securities be excluded? Why or why not?
