Much of the states rights problem comes down to whether the US should have a single standard of human rights and individual rights. The amendments were the first step to guaranteeing that the states couldn't just trounce on individuals as they pleased.

Seems like the more we uphold certain principles of privacy, discrimination, etc. the more states rights will be stymied again by national standards of human rights.

Which is fine with me. I have argued here before that an American citizen should have the same rights in all 50 states, not be deprived if they happen to be stuck in an odd corner with peculiar views.
