All that is possible but in the modern era where rights have been "created" or "recognized" or whichever potentially pejorative adjective you want to use, the rights created nationwide have generally been acceptable to the majority of Americans.

The courts or Congress could have tried to impose all those things you mentioned. Some will certainly see them as worthy causes.

But they haven't. Broad rights aren't created on a whim by Congress or the courts. I am relying on decades of relatively sensible legislation and jurisprudence, so I don't give up on the idea that someone with a protection against harm in one state isn't stomped on just over the nearest state line.

There will never be a clear answer to this. I am mostly comfortable with how the situation has evolved.

FWIW, our resident fox doesn't bother my cats at all.
