The Marshall court was just fine as far as the Bill of Rights was concerned- some might even say they made a great improvement in the state of rights observed in the country, by making sure the states and the federal government lived up to the constitution you claim to cherish.

Lots of people said we'd say good by to the Bill of Rights with Bush as prez- and while he hasn't been great, that's the same sort of hyperbole you're using. I imagine it plays well to a choir, but it's not going to convince anyone else.
