Just repeating the point I made in the previous post. That GWB said he was modeling his SC appointments on justices he admired, specifically, as I recall, Scalia and Thomas. Perhaps the then chief jusice was on that list as well.

You said GWB's SC appointments were good because they upheld the constitution. My point is that he modeled those appointments on justices who did not uphold the constitution in the most significant decision of their SC careers.

And the most telling illustration of how they themselves concluded that they were not following the constitution is the small item, in which they asked that this decision not be precedent for any future decisions. Since precedent is one of the major if not the major point of SC decisions, it's clear they saw it as outside the constitution. In short, my term, unconstitutional.
